Terms of Service

Welcome to Examen! These Terms of Service ("Terms") govern your access to and use of the Examen mobile application ("App"), a tool for practicing the daily Examen reflection rooted in Ignatian tradition. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Use of the App
You may use the App for your personal, spiritual, and non-commercial use only. The App is designed to support your spiritual growth and daily reflection practice. You agree not to misuse the App or help anyone else do so. This includes, but is not limited to:
- Accessing or using the App in violation of any law or regulation
- Copying, modifying, reselling, or distributing any part of the App without written permission
- Using the App to store or transmit infringing, libelous, or otherwise unlawful material
- Attempting to access other users' private spiritual content or data
- Using the App for any commercial spiritual services without permission
2. Spiritual Content and Personal Reflections
The App allows you to create, store, and manage personal spiritual reflections, journal entries, gratitude notes, and prayer intentions. You retain full ownership of all spiritual content you create. This content is stored securely using Apple's CloudKit service and is private to you alone.
Sacred Nature of Content: We recognize that your spiritual reflections are deeply personal and sacred. We are committed to protecting the privacy and confidentiality of your spiritual journey.
3. Account and Data Synchronization
The App may offer account creation for synchronizing your spiritual content across devices using Apple's CloudKit service. You agree to:
- Provide accurate information if creating an account
- Keep your Apple ID and device access secure
- Be responsible for all activity under your account
- Understand that data sync depends on Apple's CloudKit service availability
4. Subscription and Premium Features
Examen may offer premium features through subscription services. Any subscription purchases are processed through the Apple App Store. You are responsible for managing your subscription through your Apple ID account settings.
Subscription features may include:
- Advanced reflection prompts and spiritual guidance
- Extended journal history and search capabilities
- Additional customization options
- Enhanced reminder and notification features
5. Intellectual Property
All content included in the App, including but not limited to spiritual guidance, reflection prompts, user interface design, and software, is the property of Examen or its licensors and is protected by intellectual property laws. The spiritual guidance and Examen methodology are based on centuries-old Ignatian tradition and spiritual practices.
6. Privacy and Data Protection
Your privacy is fundamental to our mission. We are committed to protecting your spiritual content and personal information. Please review our Privacy Policy, which explains how we handle your data. Key commitments include:
- Your spiritual content remains completely private to you
- We do not read, analyze, or share your journal entries
- All data is encrypted and stored securely via Apple CloudKit
- No advertising or third-party data sharing
7. App Availability and Updates
We strive to keep the App available and functional. However, we reserve the right to:
- Update or modify the App's features at any time
- Perform maintenance that may temporarily affect availability
- Discontinue certain features with reasonable notice
We will make reasonable efforts to preserve your spiritual content during any updates or changes.
8. Termination
You may stop using the App at any time. Your spiritual content stored in CloudKit will remain accessible through your Apple ID. We reserve the right to terminate access for conduct that violates these Terms, though we will make every effort to preserve your personal spiritual content.
9. Disclaimer of Warranties
The App is provided "as is" and "as available." While we strive to provide a reliable spiritual companion, we cannot guarantee uninterrupted service. To the fullest extent permitted by law, we disclaim all warranties, express or implied.
Spiritual Guidance: The App provides tools for reflection based on traditional Ignatian spirituality. It is not intended as a substitute for professional spiritual direction, pastoral care, or mental health services.
10. Limitation of Liability
To the extent permitted by law, Examen shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of or inability to use the App. This includes any loss of spiritual content due to technical issues, though we implement robust backup systems to prevent such loss.
11. Spiritual and Religious Considerations
Examen is rooted in the Ignatian tradition of spiritual reflection. While designed to support spiritual growth, the App:
- Respects users of all faith backgrounds and spiritual traditions
- Does not require adherence to any specific religious beliefs
- Provides tools for reflection that can be adapted to your personal spiritual practice
- Is not intended to replace personal spiritual direction or pastoral care
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the developer is based, without regard to conflict of law principles.
13. Changes to Terms
We may revise these Terms periodically. When changes occur, we will:
- Notify users via in-app notification
- Update the "Effective Date" above
- For significant changes, provide additional notice
Continued use of the App after changes constitutes acceptance of the updated Terms.
